One of the fundamental principles of our company is compliance with the User Data Confidentiality as stated in the Personal Data Protection Law (EU) 2016/679 ("General Data Protection Regulation" or "GDPR"). To comply with the requirements of the GDPR, and protect our users' personal data, our company is committing to allocate all the necessary resources. This confidentiality policy describes the types of data we collect, and how we use our users' personal information obtained while they browse the website.   1. What is GDPR?

 

On May 25, 2018, came into effect the EU General Data Protection Regulation 2016/679 regarding the protection of personal data processing and the free circulation of data, as well as the repeal of the 95/46 EC Directive (General Data Protection Regulation) known as GDPR. This regulation states that every company or operating entity engaged in the processing of personal data is required to comply with the new stipulations and transparently provide information on their methods of personal data processing.

 

 

1.     Why is the processing and collection of personal data required?

 

According to the requirements of GDPR and the obligation to protect your personal data stored in our databases, we hereby notify you that this information is used only to perform successful commercial transactions with our clients, namely for ordering, selling, order placing, delivery, warranty, and client service.

 

2. What type of personal data do we process?

 

We collect information for the convenient use of our services. We receive what can be considered “personal data” when you perform the following actions:

 

1) create an account or purchase goods on our website (in this situation it is your name, surname, contact number, electronic address, physical address, payment method, bank card details, etc.)

2) request assistance from our customer support (this can be, for example, a phone number);

3) fill out contact forms or request any information from us (for example, an email address);

4) participate in contests and surveys, apply for a job, or participate in other activities we run that may require information about you.

 

However, we also collect additional information when we want to ensure our customers get the highest customer service quality. These data collection methods may not be as obvious, so we would like to clarify what they may be and how they are performed (given that they may change).

 

3. How do we use the information we receive?

 

 According to the Regulation (EU) 2016/679 and the current legislation of the Republic of Moldova, personal data is used exclusively for the relationship between our company and the target person (client). We provide maximum confidentiality of your data and use it only for the purposes for which it was collected. We use your Personal Data for the following purposes:

 

4.1. To communicate with customers

 

a) Access to the site - when visiting the site www.pico.md, some information in the form of server protocols (log files) is automatically saved every time you open the website or its files. Each data package includes information such as the web page from which the visit to our site was made, IP address, date and time of access, client web request, HTTP response code, amount of data transferred, browser type, platform type.

 

b) Determining locations - using IP addresses, we can determine the geographic location of our users. At the end of each session, we do not store the IP address for location tracking.

 

c) Customer account - when you register a new account on the platform www.pico.md and fill out the fields below the "New customer" questionnaire, we will save your data in our database. At any time, you can request the deletion of this information and your account. When you place an order on our website, the information you entered will be processed to successfully complete the purchase.

 

d) Checkout - We use personal data stored in your account to process requests necessary for online purchasing.

 

e) Delivery of goods - For the proper fulfillment of our contractual obligations, we process your personal data for a successful delivery operation.

 

4.2. If you want to apply for a job at our company, go to the Vacancies page on our website and send in your resume. We will review your resume, and we will contact you if a vacancy appears. We store your data in our database, and we ensure their safety according to the law.

 

4.3. Information for Customer Relations;

We can contact you directly or through a third-party service provider regarding the products or services that you have purchased or subscribed to, for example, to send service-related messages. We may also contact you to offer additional services based on your needs and interests. Possible means for contact: email; text messages (SMS); phone calls; automatic phone calls or text messages.

 

If we collect information from you concerning an offer from a partner, it will be clear at the time of contact who is collecting the information, and whose privacy policy should apply.

 

Also, you will be presented with choices regarding the use or disclosure of your personal information to a partner, and details on how to use these options. 4.4. To fulfill requests from a legal or a government entity;

We work with government officials and law enforcement individuals to enforce the law and make sure we follow it correctly. We may disclose your personal information to the government or law enforcement officials and individuals if we find it necessary for the protection of your property and your safety or the protection of the property and the rights of third parties. We take these measures to ensure public or personal safety or to prevent or stop illegal activities. 4.6. For the Cookie Files;

5.1. Personal data recipients;

Personal data recipients must comply with the requirements of the current legislation. Access to personal information or its transfer can be provided to:

Employees of our company to register new customers or process an order;

The Logistics Department for the delivery of the order;

Company Partners;

Payment/banking service providers;

Marketing research service providers;

Service providers for promotion and advertising;

Before placing an order, we kindly ask you to read these terms and conditions thoroughly. They contain the main rules and principles that will regulate the purchase of goods from the www.pico.md website.

By placing an order on the online store, the Buyer acknowledges and confirms that they familiarized themselves and agree with the commercial terms described below and deem them binding.

 

Commercial Terms

 

§1. The Scope

 

These Commercial Terms describe the conditions of the online Sell & Purchase agreement for goods (hereafter referred to as the Product), which Heldmico SRL (hereafter referred to as the Seller) performs with the consumer (hereafter referred to as the Buyer) on the online store www.pico.md (hereafter referred to as the online store). These terms establish the rights and obligations of the parties, including some restrictions.

Only the Buyers can perform Product orders - such individuals who intend to order, receive, and use the goods.

Product assortment showcased on our online store, the description of the main properties, price, delivery conditions, available quantity numbers, and other conditions are valid for the day and time they are posted on the website and can be subject to change by the Seller without prior notice to the Buyer.

The new selling terms will come into effect from the moment they are posted on the online store.

After the order placed by the Buyer is confirmed, the terms can only be modified only upon mutual agreement of the parties.

For economic reasons, the Seller has the right to limit the number of items per order. This applies both to the number of products within one order, as well as placing multiple orders for the same product.

The Product ordered on the online store cannot be reserved and will be shipped per the stock availability.

The products can only be shipped and delivered within the Republic of Moldova.

The terms and conditions of shipping and delivery on the territory of Transnistria may differ from the existing conditions due to the particularities established by the current legislation of the Republic of Moldova.

 

§2. Ordering from the online store

 

The product of interest for the Buyer can be selected from the product assortment available on the store and can be sent to the Cart by the Buyer by clicking the “Add to cart / Buy now” button.

Before sending the order, the Buyer has the option to once again view all the product information for the products in their Cart (the name, quantity, Buyers’ information, including the address and phone number, the prices, shipping price, payment method).

 If deemed necessary, the Buyer can change the list and the quantity of the products, as well as the Buyer’s personal information.

After the Buyer clicks the “Confirm order” button, they will receive a confirmation email to the address specified in the order, for their own records.

After the Seller’s operator receives the order, they will contact the Buyer on the phone number specified as soon as the order is placed. The agreement legally concludes at the moment of the verbal confirmation of said order by the Buyer to the Seller’s operator.

The Buyer’s order is saved in their personal account and can be viewed by them at any time.

 

§3. Price Policy

 

All the prices in the online store include the VAT.

The product price does not include the shipping cost.

 

§4. Shipping and Shipping Costs

 

Shipping Policy

 

The products will be Shipped and Delivered to the address provided by the Buyer at the time of order.

 

Attention!

In case of an emergency change of address, please, notify immediately of your new address by calling our team members at the phone number +(373) 22 802 822.

We will deliver the products in the Chisinau area within three working days, to any other location within five working days.

For long-distance delivery order tracking and status inquiries, you can call our hotline number +(373) 22 802 822.

Our business days are Monday through Friday from 9:00 to 19:00 except for the public holidays.

If you intend to pay for the goods in cash, the delivery time is calculated from the date of the final agreement according to section §2 Ordering from the online store

In case of a non-cash payment option, like a bank transfer, the delivery time starts from the day the funds are cleared and transferred into the Seller’s bank account.

If the Buyer postpones the date and/or changes the delivery address more than two times, we will cancel the order. In this case, the Buyer will have to place the order all over again.

We do not count Weekends and Public Holidays as delivery days.

At the time of delivery, a Seller representative is authorized to perform transactions with the Buyer.

Delivery costs are calculated and paid for separately.

 

§5. Receiving the Product

 

To receive the products, the Buyer has to show an ID document or a driver’s license issued by an authority of the Republic of Moldova.

The product handover will take place after the Buyer signs the following documents:

Delivery form (original), Tax invoice (as stipulated by the law).

 

The Buyer will also receive the following documents:

      Receipt;

      Tax invoice (as stated by the law);

      Delivery form (the copy);

If the Seller performed the delivery within the established terms, but the goods were not handed to the Buyer through his own fault, the Buyer is obliged to compensate the Seller for the delivery cost.

The Buyer and The Seller will schedule a subsequent delivery under new terms. The Buyer will be charged additionally for the re-delivery of goods.

 

§6. Payment Methods

 

The Buyer can pay for the goods both by bank transfer, by Visa/Mastercard on delivery or directly online (including the use of the payment tools displayed on the website www.pico.md) or in cash.

 

A bank transfer payment is considered final from the moment the funds are credited to the Seller’s bank account.

 

§7. Obligations of the Parties

 

The Seller shall:

 

      Timely and properly receive and process the order;

      Deliver the products on time to the address indicated by the Buyer;

      Handover the products and the accompanying documentation to the Buyer;

      Perform other duties required by the current legislation of the Republic of Moldova in regards to the seller-buyer agreement;

 

The Buyer shall:

 

      Place the order correctly;

      Provide reliable personal information for a successful order completion;

      Pay in full the cost of the products using one of the methods available;

      Provide the correct and detailed delivery address and be ready to accept the Products, make a handwritten note on the receipt of the goods on the Delivery Form;

      Perform other duties required by the current legislation of the Republic of Moldova in regards to the seller-buyer agreement;

 

§8. Confidentiality and Personal Data Protection of the Buyer

 

The Buyer shall provide the true, accurate, and complete information about himself and his address when placing an order and keep the information up to date.

 

If the Buyer provides inaccurate information or the Seller has serious grounds for doubting that the information provided by the Seller is complete, accurate or if it violates third-party rights, the Seller has the right to suspend or cancel the registration, or refuse entirely to fulfill an order.

The Buyer confirms that by acting voluntarily, of their own free will and in their own interest, gives the Seller consent to process personal data (any operations or set of operations performed both automated and manual, such as collecting, recording, recovering, organizing, adaptation or modification, retrieval, consultation, use, disclosure by transfer, distribution, grouping or combining, blocking, erase or destruct). The purpose of personal data processing is registration on the website, identifying, informing, negotiating, finalizing and executing the agreement, registering tax invoices and other primary documents, verifying orders, invoicing, shipping, participation in promotions, evaluation and analysis of the website performance, online store, and the Seller’s hotline, for advertising products, works, and services. We will use various communication means like the phone, email, mailing list, internet, and other legal means determined by the Seller’s policy.

 

We process the following types of personal data: first and last name, signature, identification number (IDNP), cell phone number, landline phone number/ fax, email address, physical address (permanent or temporary). Identification number (IDNP) is needed only when its processing is expressly required by the law or when the Buyer gives their consent.

 

The Buyers can invoke Law no. 133/08.07.2011 on the protection of personal data, namely the right to information, access to data, the right to interfere, the right to oppose, the right to avoid individual decisions, the right to go to court in case of violation of their rights.

Buyers have the right to request complete or partial deletion of their personal information, as well as of their user account.

The Buyer can exercise any of the above rights by sending a written request to the Seller's address: 37, st. Calea Orheiului, Chisinau.

 

The Buyer has the right to opt-out of the processing of personal data for marketing purposes following the current legislation of the Republic of Moldova. The Buyer may do so by sending a corresponding letter to the Seller's address: 37, st. Calea Orheiului, Chisinau.

 

By using our website, the Buyer agrees to the use of cookies, which will store the following information: IP address, date and time of access, page title, Session ID, Link URL (from the website referring to our website), the amount of data transferred, browser version, and operating system.
